2.07 VESSEL FORMS OF OWNERSHIP
The HMC will recognize only two forms of vessel ownership, Partnerships and Sole Ownership.
2.07A Partnerships
The HMC supports vessel partnerships as a way
to increase member access to
boating. The committee expects that members forming a vessel partnership
do so in order to share the purchase, operating and maintenance costs of
the vessel.
Partnerships of convenience, formed in order to
secure or preserve
rights to a berth, when the partners do not expect to share expenses or
share use of the vessel, are prohibited. Such partnerships should expect
scrutiny, and may be asked by the HMC to provide records documenting
that expenses and use of the vessel, are in fact shared. Failure to meet
a
demand for such records may result in termination of the Berth License
agreement and as such, the HMC recommends that partners keeps good records
regarding shared expenses and a log documenting vessel use.
2.07B Partnership Qualifications and Berth Use
All Berth License offerings are made based on the Harbor Wait List member’s chronological position. All partners in a partnership must be a CYC member in good standing prior to entering into a partnership agreement with the partner licensee. Forming a partnership not approved by the HMC in accordance with these rules may be grounds for suspension or revocation of the Berth License agreement.
2.07C Partnership Approval & Required Documentation
In order to obtain HMC approval for a partnership owned vessel in a berth, the Harbor Wait List member must show upon request by the HMC that he/she has kept or obtained an interest of not less than 50% of the vessel ownership to include profits, losses and liabilities of the vessel partnership.
2.07C-1 Partnership Books and Records
The HMC may periodically request books and records demonstrating partnership vessel use and shared expenses for berthing, maintenance, insurance and taxes.
2.07 D Partner Licensee Survival
If the partner licensee who was the Harbor Wait List member, has deceased or ceases to be a partner in the vessel as defined in these rules, the remaining partner(s) are not allowed to continue use of the partnership vessel berth and must relinquish the berth to the HMC.
2.07E Sole Ownership
Vessel sole ownership consists of one individual owning 100% of the vessel. Sole ownership is also a recognized form of ownership when the vessel is 100% owned by regular & spousal members as defined in the CYC By-Laws.
2.08 VESSEL LENGTH AND BEAM
The following vessel size guidelines are established to determine vessel suitability for berth occupancy. The HMC uses these guidelines to optimize available berth space within the harbor. An in-water berth/vessel fitting as conducted by the HMC will be the final determination of vessel suitability.
2.08A Vessel Length Limitations
The HMC has established a minimum vessel length for any given berth. The maximum vessel length that any given berth can accommodate is the same as the length of the dock that serves that berth. Vessels are not allowed to overhang (i.e. they must not intrude into the walkway, forward, nor intrude significantly into the fairway, aft). Vessel lengths are lengths overall (LOA) that includes both swim platforms and bow sprits.
Following is a listing of minimum vessel lengths for each line and associated berths within the line. All dimensions are in feet.

For vessels 40 feet in length (LOA) and longer, the maximum vessel beam is the width of the berth minus 12” for berths with one finger and minus 24” for a berth with two fingers.
2.08B-1 Vessel Beam Exception
If a boat qualifies for vessel length and does not qualify for vessel beam, the Harbor Wait List applicant may select an alternate berth when available that will accommodate the vessel beam.
2.09 SUBLETTING or Assignment of Rights
A berth licensee may not sublet a berth, or assign berthing rights. A berth may only be sublet during an approved leave of absence or prior to initial occupancy as approved by the HMC.
2.10 Berth License Agreement
All berth licensees shall be required to execute a Berth License agreement which shall include but not be limited to the following provisions as well as provisions contained elsewhere in these rules:
2.10A Number of Berth License Agreements
Only one Berth License agreement will be awarded to an applicant (the berth licensee) regardless of how many names are on the application. Berth License fees are billed and due monthly.
2.10B Required Documentation
Every vessel occupying a berth must have a current DMV Registration or be a documented vessel with the United States Coast Guard (USCG). A DMV registered vessel must display current registration numbers and stickers in accordance with applicable state and local laws. The berth licensee must appear on the vessel title as evidenced by a copy of the DMV registration or USCG documentation.
2.10C Documented Multiple Names
In the event more than one name is shown as the Registered Owner or Documented vessel owner, all must be Regular CYC members. In the case of a Partnership form of vessel ownership, all Partners’ names must appear on the title and be Regular CYC members.
2.10D Required Insurance
Every berth licensee is required to provide annually, evidence of liability insurance in an amount to be determined by the Board of Directors with the CYC appearing as an additional named insured on the policy.
2.10E Compliance
Berth licensees shall agree to be bound by the Harbor Rules and Regulations.
2.11 berth Occupancy Rights
2.11A Terms
All Berth License Agreements will be on a month to month basis. No berth licensee shall be dispossessed of their Berth License rights except for;
a) Consistent or repeated violation of the Harbor Rules and Regulations as determined by the HMC;
b) Failure to comply with the vessel ownership or insurance requirements;
c) Cessation of membership in Corinthian Yacht Club.
d) Reassignment of a berth by the HMC when in the HMC’s opinion, the size of the vessel does not meet the size requirements of the berth.
2.11B Dissolution of Marriage
In the event of Dissolution of Marriage, if only one divorcing spouse retains Regular membership, then that spouse is entitled to the berth. If both spouses retain Regular Membership, then only one may retain the berth. Divorcing Members are encouraged to ensure that berth rights are delineated in the appropriate legal documents regarding the Dissolution and the Club will honor such determinations, subject to other applicable requirements concerning membership status, payment of fees, etc. If the berth rights are not delineated in the appropriate legal document, then the divorcing spouses may, within 90 days of final dissolution, direct that the berth rights be assigned to either ex-spouse. If neither the dissolution documents nor the parties specify the assignment, then the berth shall be assigned to the member originally listed as the primary member on the membership application.
2.12 Temporary Vacancy and Leave of Absence
2.12A Temporary Vacancy
All Berth Licensees who intend to temporarily vacate their berths overnight or longer must notify the Club Office in advance of the intended departure. Berths left unoccupied without advance notice will be deemed an indefinite vacancy. The HMC shall have the right to permit others to occupy the berth during an indefinite vacancy without compensation to the Berth Licensees and without assurance the berth will be vacant upon the Berth Licensee’s return, unless the Club Office is notified not less than twenty-four (24) hours in advance of the time of return. Any berth left vacant for more than three (3) months without a granted leave of absence by the HMC shall be cause for termination of the Berth License Agreement and the berth shall be considered vacant. The berth will then be posted as an available Berth License for Harbor Wait List member application.
2.12B Leave of Absence
Upon giving good cause such as cruising or racing beyond the Bay Area, seasonal relocation to the Delta, or major vessel yard repairs, a Leave of Absence may be granted by the HMC for a period up to two (2) years or longer at the discretion of the HMC. During such Leaves of Absence, the Berth Licensee shall remain fully liable for the payment of all Berth License fees, but if during such period the Club is able to collect sublet fees (as opposed to guest berthing fees), seventy-five percent (75%) on any such collected fees shall be credited to the account of the berth licensee. A Leave of Absence is not intended to be used and neither shall it be granted for maintaining occupancy of a berth while a vessel is berthed elsewhere in the Bay Area or the Berth Licensee has sold the vessel occupying the berth.
2.13 Temporary Relocation
All Berth licensees are required to fully cooperate with the CYC by vacating their berths as requested for harbor repair work, dredging and special events such as invitational regattas and vessel shows. These events may require overnight or extended (up to two weeks) berthing outside the Club’s harbor. The Club will use reasonable efforts to find alternative berthing at other marinas or yacht clubs, guest docks or moorings. Responsibility for moving and securing vessels lies with berth licensees but Club staff will assist in every possible way. The HMC and the CYC will not be responsible for any damages resulting from a vessel relocation and temporary berthing by staff should the vessel owner not move his/her vessel as instructed by the HMC.

Any costs associated with this work will be charged to the account of the Berth licensee at CYC staff’s prevailing labor rates and marked up cost of materials. Nothing contained herein shall be intended or construed to create or imply any obligation or agency, contractual or otherwise, by the HMC or CYC staff to maintain or replace dock lines and sole responsibility therefore or any consequential damages resulting there from, shall at all times reside with the Berth Licensee.
